When is a candidate considered a Member of the House of Representatives? | June 20, 2025
The Supreme Court has invariably held that once a winning candidate has been proclaimed, taken his oath, and assumed office as a Member of the House of Representatives, the COMELEC’s jurisdiction over election contests relating to his election, returns, and qualifications ends, and the HRET’s own jurisdiction begins.
A candidate is considered a Member of the House of Representatives when the following requisites concur: (1) a valid proclamation; (2) a proper oath; and (3) assumption of office.

The doctrine of fair use allows the courts to deviate from strictly applying the copyright laws when their rigid application would stifle the creativity that they are designed to foster and when it would frustrate the State’s function to promote the diffusion of knowledge and information.
