Termination of employment due to loss of trust and confidence

Loss of trust and confidence is among the just causes for termination of employment. Under Article 297(c) of the Labor Code, the grounds by which employment may be terminated are provided for, and among which is when there is a willful breach of the employee of the trust reposed in him by the employer or his duly authorized representative. Settled is the rule that breach of trust must be willful, i.e. when it is done intentionally and knowingly without any justifiable excuse, as distinguished from an act done carelessly, thoughtlessly or inadvertently
